Reward Program

These Terms and Conditions govern your membership in the 1981 Noodle House Rewards Program ("1981 Rewards" or the "Program"). Participation in 1981 Rewards is also subject to our general Terms of Service and Privacy Policy, which are incorporated herein by reference. By enrolling in the Program, you agree to these Terms. If you do not agree, do not sign up for the Program. Enrolling in the Program indicates your acknowledgment and acceptance of these Terms.

PLEASE READ THESE TERMS CAREFULLY, INCLUDING THE ARBITRATION PROVISION IN SECTION 12, WHICH REQUIRES THAT MOST DISPUTES BE RESOLVED BY FINAL AND BINDING ARBITRATION ON AN INDIVIDUAL BASIS, NOT A CLASS-WIDE OR CONSOLIDATED BASIS AND WAIVE YOUR RIGHT TO A TRIAL BY JURY.

BY ACCESSING OR USING OUR SERVICES, YOU AGREE TO BE BOUND BY THESE TERMS AND ALL TERMS INCORPORATED BY REFERENCE. IF YOU DO NOT AGREE TO THESE TERMS IN THEIR ENTIRETY, DO NOT USE OUR SERVICES.

1. MEMBERSHIP

1981 Rewards is available to legal residents of New Zealand where 1981 Noodle House operates. The Program is not intended for anyone under the age of 16. All Members must be at least 16 years old. If you are under 18, a parent or guardian must review and agree to these Terms and be responsible for your compliance. Membership requires a valid email address. Business entities, third-party aggregators, organizations, or groups cannot enroll or benefit from the Program. Individual accounts cannot be combined or shared. 1981 Noodle House reserves the right to limit participation at any time. A Member’s account must be in “Good Standing” to receive benefits, meaning it is not banned, suspended, or deactivated.

2. REWARDS PROGRAM

1981 Rewards allows Members to earn points for purchases that can be redeemed for menu items (“Rewards”), subject to availability at Participating Locations. One (1) “1981 Point” is awarded 3% on any Qualifying Purchases.  “Qualifying Purchases” include food, beverage, or in-store merchandise purchases of at least one cent ($0.01). There is no fee to join the Program. Points cannot be sold, transferred, or shared, except as provided in these Terms. Each Member may only have one (1) 1981 Rewards account.

2.1. Account Identification to Receive Points

(a) To receive credit for in-store transactions, you must identify your account at the time of purchase.

(b) If ordering online, log into your Member account to receive points.

2.2. Points

(a) Points are earned at participating 1981 Noodle House locations. Points have no cash value and are not redeemable for cash, gift certificates, or gift cards. Points expire one (1) year (365 days) after the last Qualifying Purchase. Points expire upon account termination, deactivation, or closure. 1981 Noodle House reserves the right to adjust point earning and redemption values at any time.

(b) Canceling or voiding Qualifying Purchases will deduct any earned points.

(c) From time to time, we may offer opportunities to earn extra points (“Bonus Points”) through special promotions.

2.3. Points Calculation

Points earned on Qualifying Purchases will be rounded up to the nearest number. For example, a purchase of $60.41 will earn 3.02Points ($60.41 x 0.03 = 1.8123 Points; rounded to 1.81 Points).

2.4. Points Restrictions

(a) Items not eligible for earning points include tip, delivery fees, service fees, gift card purchases (unless through a special promotion), and purchases made through third-party platforms.

(b) Points, Rewards, Offers, and Member Benefits cannot be gifted, sold, or transferred, except as otherwise provided.

(c) Attempts to redeem single-use offers multiple times or through multiple users constitute fraud and may result in account suspension or deactivation.\

3. REDEEMING POINTS

Redeem Your Birthday Gift Reward

Members eligible for a Birthday Gift must have their birthdate in their profile and be in Good Standing. A Birthday Gift will be presented within the week of the Member’s birthday and can only be redeemed once every 365 days.

4. REWARDS, GIFTS, AND OFFER RESTRICTIONS

Only one (1) coupon, promotion, Reward, Welcome Gift, Good Fortune Gift, Birthday Gift, or Offer can be applied to any order, unless otherwise specified.

5. AUTHORIZATION TO COLLECT INFORMATION AND PERMISSION TO MARKET TO MEMBERS

By enrolling in the Program, you agree that you may be asked to provide personal information, which will be used by 1981 Noodle House and its partners to operate the Program and provide benefits. We may also use your information to send marketing communications, including emails, text messages (if opted-in), push notifications, direct mail, and special promotions.

6. OPTING OUT OF MARKETING

6.1. You may opt out of marketing materials by using the unsubscribe link in messages, adjusting your communication preferences in our mobile app or website, or replying “STOP” to text messages.

6.2. Opting out of marketing materials will not affect your participation in the Program, but you may not receive all offers.

7. UPDATING MEMBER INFORMATION

You can update your Member information by email info@1981noodle.co.nz or call any of our store. Correct information is necessary to receive Program benefits.

8. CANCELLATION BY MEMBER

You may cancel your membership at any time by notifying us online or by email. Cancellation may take up to four (4) weeks to process. Inactive accounts for 24 consecutive months may be automatically canceled. Upon cancellation, all points, Rewards, Gifts, and benefits will be deactivated.

9. ABUSE OF THE PROGRAM

We may invalidate points, terminate, or suspend your account if we determine that you are ineligible, violated terms, used someone else’s transactions, used multiple identities, committed fraud, or circumvented Program policies. If your points are forfeited, they will not be reinstated.

10. DISCLAIMER OF REPRESENTATIONS AND WARRANTIES

THE PROGRAM IS PROVIDED "AS IS" AND "WITH ALL FAULTS." 1981 NOODLE HOUSE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

11. DISPUTE RESOLUTION, BINDING ARBITRATION

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS AND REQUIRES ARBITRATION FOR MOST DISPUTES, WAIVING YOUR RIGHT TO A JURY TRIAL.

11.1. Agreement to Arbitrate

You and 1981 Noodle House agree to binding arbitration for any “Covered Claims” that arise between you and 1981 Noodle House. This agreement is governed by the Federal Arbitration Act.

11.2. Claims Subject to Arbitration

“Covered Claims” include disputes related to these Terms, your access to and use of services, and related issues.

11.3. Excluded Claims

“Excluded Claims” include claims that cannot be arbitrated as a matter of law, applications for provisional remedies, and small claims actions.

11.4. Class Action Waiver and Jury Waiver

You and 1981 Noodle House agree to arbitrate Covered Claims on an individual basis, waiving class action rights. If a claim proceeds in court, both parties waive the right to a jury trial.
